Divorce

You can apply for a divorce after you have been separated for one (1) year. You can apply without the other party’s agreement.

Our standard price for a divorce is $880 including GST, not including the Court’s filing fee and any other third party expenses.

 

Dividing property

If you and the other party have been married or have been in a de facto relationship, it is often advisable to formalise any agreement to divide property by way of Family Court orders. These orders will protect you from a future claim by the other party and will allow you to pay nominal stamp duty on the transfer of land.

Our standard price for formalising an agreement by way of Family Court orders is $1,760 including GST, not including the Court’s filing fee and any other third party expenses.

We can also advise you and negotiate on your behalf if there is currently no agreement regarding how property is to be divided.

 

De Facto relationships

If you and the other party have been in a de facto relationship for at least 2 years, you can make a claim to each other’s
property. A claim can also be made in certain circumstances where the de facto relationship has been for less than 2 years, such as where one party has made substantial contributions and would suffer a serious injustice without the assistance of the Family Court.

 

Parenting arrangements

We can assist in negotiating and formalising parenting arrangements for your children. We can also represent you in mediation or in
commencing proceedings in the Family Court to seek alternate parenting arrangements.


Living expenses

In certain circumstances you may be entitled to receive financial support from the other party that is separate to a property
settlement or child support. This is called spousal maintenance.

We can advise you in respect of your prospective entitlements to spousal maintenance and represent you in claiming spousal maintenance.


Forward planning

You and the other party can enter into a formal agreement setting out the division of your property in the event that you separate. You can do this whether you are married or a de facto couple. In Australia, this agreement is called a ‘financial agreement’ or a ‘binding financial agreement’.

We can draft a financial agreement for you or advise you on a financial agreement prepared by the other party.

 

Child support

Child support can be assessed and collected through Services Australia. However you are able to formalise alternate child support
arrangements through a child support agreement with the other party.

We can negotiate and draft a child support agreement for you setting out alternate child support arrangements.

 

Restraining orders

If you have concerns for your safety from the other party, you should contact the Police and should also consider obtaining a Family
Violence Restraining Order (“FVRO”) for your protection.

We can represent you in a FVRO application and can negotiate with the other party on your behalf regarding finalising or withdrawing a FVRO application.
